“NOTICE: Effective January 1, 2023, the limits for the amounts involved in disputes for civil cases will be increasing from $30,000 to $50,000.”

County Civil has jurisdiction over claims up to and including $50,000, which includes small claims cases up to $8,000. Evictions and replevin cases are also handled in County Civil. You may download County Civil packets from the Forms page or use TurboCourt to auto-populate the documents and file them electronically. The Small Claims Process

Complete instructions for filing a small claims case are included in the Statement of Claim packet.

Small claims are civil lawsuits between plaintiffs, who are bringing the lawsuit, and defendants, who are being sued. When bringing a lawsuit, it’s important for the plaintiff to sue in the correct name and sue the correct party. If a judgment is issued against a party that does not exist (improper spelling or incorrect/incomplete name), the judgment may be worthless.

Civil Differentiated Case Management

Effective April 29, 2021 the Nineteenth Judicial Circuit has implemented Differentiated Case Management Plans. Visit the Nineteenth Judicial Circuit's website for more information, forms, and administrative orders related to Differentiated Case Management.

Differentiated Case Plan
  • Individual: Full name, address and telephone number (parent/guardian must bring suit if not over 18 years old)
  • Partnership: Each partner's full name and business name, address and telephone number
  • Corporation: Full legal name and d/b/a, if any, registered agent or president's name. Information for partnership and corporation may be found by checking occupational licenses in the county or city where the business is located, or through the Secretary of State, Division of Corporations online Document Searches or by calling 800-755-5111. You also must list the registered agent's address for service of process.
  • Company: Full name of owner and company (John Smith d/b/a ZYX Company), address and telephone number.
  • Insurance Company: The EXACT name of the insurance company is needed. Claims against an insurance company must be served through the Insurance Commissioner's Office. The charge is $15.

When filing a claim based upon a written document or contract, a copy must be furnished for the file and one for each defendant at the time of filing. If at any time during the proceedings a settlement is reached between the parties, you should notify the Clerk's office immediately. You must advise the Clerk, in writing, of any change in your mailing address.

Rehearings and Appeals

Any unsuccessful party has no later than 15 days from the date the judgment is entered to move for a new trial. Parties have the right to appeal the judgment entered and must do so no later than 30 days from the date the judgment is entered.

Options to Collect a Judgment

Record a certified copy of the final judgment with the Clerk. The charge for recording is $10 for the first page and $8.50 for each additional page (include a self-addressed, stamped envelope or $.75 postage). The recording of the certified copy creates a lien of record against any real estate in the county where recorded then or thereafter owned by the defendant. Certified copies are $1 per page plus $2 for certification.
